The TopXML web site logs IP addresses for systems administration purposes. IP addresses are logged to track a user's session. This gives TRUSTe an idea of which parts of our site users are visiting. Information about you is collected by TopXML during the registration for membership process.

When you choose to register, our site's registration form requests (but not not require) users to give us contact information (like their name and email address) and demographic information (like their age or income level). Should you request it, we use customer contact information from the registration form to send the user information about our company. We run polls and contests on our site (in order to win a book for example) in which we may ask visitors for contact information (like their email address). We use contact data from our contests to send users information about our company and promotional material from some of our partners. TopXML Cookies

TopXML use what we call "cookies" to store member names and passwords. This is an optional feature and applies only to users who have registered to be a members AND who have also requested to be "remembered".  In this way we ensure you do not have to logon each time you visit our website.

Third party organizations (such as advertising companies or Pollit.com who runs our polling feature store cookies on your machine) in order to ensure uniqueness.  Again, these cookies do not identify you or your machine, they are simply there (for example) to ensure you cannot vote in the online poll twice!

Advertising companies store cookies in order to measure and report aggregate information to advertisers such as the number of people who see their ad (reach) and the number of times people see their ad (frequency). It also allows us to deliver ads that are more relevant to you and avoid delivering the same ads too many times.

The TopXML website, name and URL is owned by Mark Wilson.

Content

Where a member has contributed content to TopXML, said content remains the property of the contributor and does not transfer to TopXML or it's owners.

By allowing TopXML to use the said content, no ownership of TopXML is transferred to the contributor, either directly or indirectly.

TopXML will not sell or resell any content which is not owned by TopXML.

Lawful purposes only

All services (free web space, promotional opportunities or other) provided by TopXML to members or visitors (or other) may be used for lawful purposes only.

Transmission or storage of any information, data or material in violation of any country law is prohibited. This includes, but is not limited to: copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret and other statue.

The members, subscribers, visitors or users agree to indemnify and hold harmless TopXML from any claims resulting from the use of the service which in any way damages the visitor, member or any other parties.

Pornography and spamming

Pornography and sex-related merchandising are prohibited on any TopXML server. TopXML will be the sole arbiter as to what constitutes a violation of this provision.

Cancellation of service

TopXML may suspend this service at any time and for any reason, without notice.

TopXML exercises no control whatsoever over the content of the information passing through TopXML.

TopXML also disclaims any warranty of merchantability or fitness for a particular purpose. TopXML will not be responsible for any damage suffered. These Terms and Conditions supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted. Use of TopXML constitutes acceptance of these Terms and Conditions.
